Welcome to Lead Vibrant. These Terms of Service (“Terms”) govern your access to and use of the Lead Vibrant platform, including our website, dashboard at dash.leadvibrant.com, and all related services (lead generation, AI business reports, contacts & CRM, email and SMS marketing, and invoicing). By creating an account or using our services, you agree to these Terms and our Privacy Policy.

1. Eligibility and Account

You must be at least 18 years old and have the legal authority to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete registration information and notify us of any unauthorized use.

2. Acceptable Use

You agree to use Lead Vibrant only for lawful purposes and in accordance with these Terms and applicable laws. You must not:

  • Use the platform to send spam, unsolicited commercial messages, or to harass or harm others.
  • Scrape, copy, or misuse data or content in violation of our policies or third-party rights.
  • Attempt to gain unauthorized access to our systems, other accounts, or third-party services.
  • Use the service for any illegal, fraudulent, or abusive purpose.
  • Resell or redistribute our services or data in a manner not permitted by your plan.

We use public and permitted data to power lead generation, AI reports, and marketing features. Compliance with anti-spam and data-protection laws (e.g., CAN-SPAM, GDPR) is your responsibility when using email and SMS features.

3. Subscription and Payment

Paid plans are billed in advance (monthly or annually) as described at signup. Free trials may be offered at our discretion. You authorize us to charge your payment method (via Stripe) for recurring fees until you cancel. Refunds are handled according to our refund policy stated at purchase or in the dashboard. We may change pricing with reasonable notice; continued use after changes constitutes acceptance.

4. Intellectual Property

Lead Vibrant and its content, features, and technology (including software, design, and branding) are owned by us or our licensors. You receive a limited, non-exclusive license to use the service for your internal business use in accordance with these Terms. You do not acquire any ownership rights in our platform or data we provide.

5. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE. SEE OUR DISCLAIMER FOR ADDITIONAL INFORMATION.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAD VIBRANT AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Termination

You may cancel your account at any time from the dashboard or by contacting us. We may suspend or terminate your access for breach of these Terms, non-payment, or for any other reason with notice where required. Upon termination, your right to use the service ceases; we may delete or retain data as described in our Privacy Policy.

8. Changes and Contact

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Material changes may be communicated by email or in-product notice. Continued use after changes constitutes acceptance.
